This Privacy Policy, along with all other Top Shelf Sports Management Inc. (“Top Shelf Sports Management”) policies, terms and conditions are collectively referred to as the “Terms”, all of which Terms may be amended from time-to-time without notice.

At Top Shelf Sports Management, we recognize that privacy is important, and we treat it as a priority. We are committed to keeping the personal information of our clients and families secure, accurate, confidential and private. We are dedicated to protecting your privacy and safeguarding your personal information.

What personal information do we collect?

“Personal Information” is any information about an identifiable individual. The personal information we collect is limited to that which enables us to conduct a personalized service for our clients and prospective clients and their families, and includes:

  • Name, address, telephone numbers, and email addresses, including regular and emergency contacts
  • Parental, legal guardian and custodial information, for safety and welfare
  • Basic health information about clients and potentially family members
  • Other health and behavioural information (ie: special needs, allergies, medical history, mental health information)
  • Financial and banking information of every kind and nature
  • Other personal information, collected either verbally or electronically to support these purposes

We collect personal information about clients and prospective clients and their families so that we can provide our service. We may also use this personal information to share updates and news on social media or other online platforms, including general marketing and publicity for clients and Top Shelf Sports Management. We also use this personal information for business analysis to continuously improve our services and reach new clients and prospective clients.

Consent

We will obtain express consent from you to collect and use personal information, or we may determine that consent has been implied in the circumstances (ie: medical, or other emergency reasons make it impossible or impractical to obtain express consent). Consent may be in writing on paper or by email, or through online forms or social platforms, or verbally in person or on the telephone. As part of the application process, and afterwards from time to time, we will request you to provide information to permit us to provide our services. In doing so, you consent to the collection, use and disclosure of such information to appropriate third parties for these purposes.

Use, disclosure and retention

Top Shelf Sports Management will only use and disclose the personal information we collect to fulfil the identified purposes, or where otherwise required by law. Only persons whose jobs and responsibilities require access to personal information will have access. Except as set out in this policy, Top Shelf Sports Management does not sell, rent, lease or otherwise disclose personal information, and retains personal information only as long as needed to fulfil the purposes for which it was collected, or as required by law. When the information is no longer required, it will be destroyed, erased or made anonymous by Top Shelf Sports Management. For clients and prospective clients and their families, personal information is retained for a period of 3 years after the last day of their playing career, after which it will be destroyed, erased, or made anonymous. Basic contact information consisting of address, phone number and e-mail address will be retained for alumni and marketing purposes.

Accuracy

It is important that your personal information is accurate and complete. You have the right to access, verify and amend the information we have about you. It is your responsibility to keep us informed of any changes, such as a change of contact information or address, health, or anything else. In that regard, please contact us as set out below.

Security

We use physical, contractual, electronic, procedural safeguards and processes to protect all personal information in our control against unauthorized access and use. Our safety and security measures are appropriate to the sensitivity level of the information involved.

Third-party terms

Our third-party providers, such as our website host or underlying technology platform such as Google, Amazon Web Services, or SiteGround, may provide for their own terms of use and other policies, including privacy policies (“Third-Party Terms”). Your personal information is subject to those Third-Party Terms which will take precedence in the event of a conflict with this Privacy Policy.

We may share your personal information with our partners who are required to keep the personal information confidential and are prohibited from using it other than to carry out their services on our behalf or on your behalf. This may include accountants, lawyers, insurance brokers, insurers, financial managers, sports teams, sports leagues, sports associations, endorsement opportunity partners and others, as well as our successors in the event of a sale, merger, acquisition or similar transaction and also including governmental authorities where required by applicable law.

Cookies and other tracking technologies

We may use cookies, beacons, tags, scripts and other information gathering technologies for a variety of reasons. These technologies may provide us with information about devices and networks you utilize to access Top Shelf Sports Management, and other information regarding your interactions with us. These technologies are also used in analyzing trends, administering our website, and tracking users’ movements around the website. We may combine this automatically collected log information with other information we collect about you to improve services we offer you, marketing, analytics and provide site functionality. We may receive reports based on the use of these technologies by third party service providers on an individual and aggregated basis, including Google analytics.

Your right to access

You have a right to access your personal information that we have in our possession. Upon written request to our Privacy Officer by e-mail at [email protected], we will inform you of the existence, use and disclosure of your personal information under our control within 30 days of your request. You may challenge the accuracy and completeness of that personal information and request that it be corrected or amended.

Additional rights for California residents

California law entitles California residents to certain additional protections regarding personal information. California residents have the right to request:

  • Information regarding your personal information we have collected (including the categories of personal information we have collected, the categories of sources of such information, and the purposes for which we have collected such information)
  • Notice of whether we have disclosed your personal information to third parties (and if so, what categories of information we have disclosed, and what categories of third parties we have disclosed it to)
  • A copy of your personal information collected by us in the previous 12 months
  • That your personal information be deleted

Additional rights for EEA/Swiss residents

If you are from the EEA or Switzerland, you may have the right to exercise additional rights available to you, including:

  • Right to erasure: In certain circumstances, you may have a broader right to erasure of personal information that we hold about you. Please note that we may need to retain certain information for record-keeping purposes, to complete transactions, or to comply with our legal obligations
  • Right to object to processing: You may have the right to request that Top Shelf Sports Management stop processing your personal information
  • Right to restrict processing: You may have the right to request that we restrict processing of your personal information in certain circumstances (for example, where you believe that the personal information we hold about you is inaccurate or unlawfully held)
  • Right to data portability: You may have the right to be provided with your personal information in a structured, machine readable and commonly used format and to request that we transfer the personal information to another data controller without hindrance

Children’s privacy protection

We do not knowingly solicit or collect personal information from children under the age of 13. If you are under the age of 13, please do not submit any personal information to us. If we are notified or discover that a child under the age of 13 has submitted personal information to us, we will take reasonable steps to delete the information.

Changes to our privacy policy

Top Shelf Sports Management may update this policy from time to time, so please review it periodically. However, regardless of our right to update this policy as indicated, we will never use personal information that you have provided to us in a new way without giving you an opportunity to give or withhold your consent.
